These Terms and Conditions (hereinafter, “Terms”) govern the use of the services provided by Televinter Services (hereinafter, “Televinter,” “we,” “our”). By accessing and using our services, the customer (hereinafter, “customer,” “you”) agrees to comply with these Terms and Conditions. If you do not agree with these Terms, we request that you do not use our services.


Introduction

Welcome to Televinter Services. By using our services, you agree to be bound by the following terms and conditions. We recommend that you read them carefully to ensure proper understanding and compliance.


1. Usage Requirements

To use Televinter Services, you must meet the following requirements:

  • Be of legal age (18 years or older) or have the consent of a legal guardian.
  • Have the necessary devices and an internet connection that meets the minimum requirements to access and use streaming services.
  • Agree to the processing of personal data in accordance with our Privacy Policy.

Acceptable Use: Users agree not to use the services for illegal or prohibited activities. This includes, but is not limited to:

  • Transmitting defamatory, obscene content or content that infringes intellectual property rights.
  • Sending unsolicited emails (spam), committing fraud, or abusing the service infrastructure.
  • Unauthorized access to other users’ accounts or attempting to disrupt the operation of the services.

Failure to comply with these policies may result in termination of access to services without a right to refunds.


2. Services Offered and Their Functions

  • 2.1 Custom Software Development
    Function: Design, creation, and maintenance of tailored software solutions to meet the specific needs of the customer.
    Conditions: Projects will be developed according to the previously agreed-upon requirements. Any additional changes will be subject to cost and time reviews.
  • 2.2 Web Development and Programming
    Function: Creation of professional websites, including WordPress solutions, aimed at improving online presence and sales.
    Conditions: The customer must provide the necessary content for web development within the established deadlines.
  • 2.3 Mobile Application Development
    Function: Development of customized mobile applications for Android and iOS platforms.
    Conditions: Applications will undergo thorough testing before launch. The customer must approve the final version before publishing on app stores.
  • 2.4 Streaming Services
    Function: Provision of streaming solutions for radio and television online, as well as the infrastructure required for broadcasting via ShoutCast, Icecast, and other related services.
    Conditions: The customer is responsible for keeping their streaming software up-to-date, managing content, broadcasting rights, and broadcast schedules.
  • 2.5 Web Hosting
    Function: Provision of hosting plans that ensure high performance and security for websites and applications.
    Conditions: The customer must keep hosted content and applications updated to avoid security vulnerabilities.
  • 2.6 Remote Technical Support
    Function: 24/7 remote technical assistance to resolve IT issues efficiently.
    Conditions: The customer will be charged for support services based on the time spent or through a monthly contract.
  • 2.7 Professional Graphic Design
    Function: Design and development of customized graphic materials, including logos, banners, brochures, and other visual products, to enhance the customer’s brand image and digital presence.
    Conditions: Designs will be created according to the specifications provided by the customer. Additional revisions will be subject to modification fees.
  • 2.8 Software Installation and Reinstallation Upon Request
    Function: Professional installation and reinstallation of software, tailored to the customer’s needs, with system optimization for superior performance.
    Conditions: The customer must provide the necessary licenses and any required access for the software installation.
  • 2.9 Additional Services
    Function: We offer a variety of additional services, such as system optimization, platform integration, data migration, and IT consulting, aimed at improving the efficiency and performance of business processes.
    Conditions: Additional services will be provided according to the customer’s specific needs and will be subject to a preliminary technical requirements evaluation.

3. Acceptable Use Policies

  • Services must be used legally and ethically.
  • The use of services for illegal activities, such as the distribution of illegal content or fraudulent activities, is prohibited.
  • Excessive use of resources that affects the service quality for other users is prohibited.

4. Payment Terms

  • Payment Methods: Bank transfers via Zelle (only in the U.S.), credit and debit cards for international clients, and PayPal.
  • Payment Conditions: Payments must be made according to the terms agreed upon at the time of service contract. Failure to make payment on time will result in service suspension and a $10 reactivation fee.
  • Advance Billing: Invoices will be generated 7 days prior to the due date and must be paid within that period.

5. Privacy Policy

6. Limitation of Liability

  • Televinter Services will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data or profits, resulting from the use or inability to use our services.
  • Our total liability for any damage related to our services will be limited to the amount you have paid in the six months preceding the incident that caused the claim.

7. Service Modifications

  • We reserve the right to modify or suspend our services temporarily or permanently, with or without prior notice.
  • Televinter Services will not be liable to the customer or any third party for any modification, suspension, or interruption of the services.

8. Service Cancellation

Televinter’s Responsibility:
Televinter reserves the right to suspend or cancel services if the customer breaches any of the established terms and conditions.

Customer’s Responsibility:
The customer may cancel the services at any time but must pay all outstanding fees before cancellation. Televinter will not be responsible for the loss of data or interruptions after cancellation.


9. Confidentiality and Data Protection

Televinter’s Responsibility:
Televinter is committed to protecting the confidentiality of the information provided by the customer and using it exclusively for the purposes related to the provision of the contracted services.

Customer’s Responsibility:
The customer must ensure that any confidential information provided to Televinter is up-to-date, accurate, and complete. Additionally, they must immediately inform Televinter of any data security incidents.


10. Compliance with Laws and Regulations

Televinter’s Responsibility:
Televinter is committed to complying with all local and international laws and regulations governing the provision of the offered services.

Customer’s Responsibility:
The customer agrees to use the services in accordance with all applicable laws, including intellectual property, privacy, and copyright laws. Any improper or illegal use of the services will be the customer’s responsibility.


11. Platform Maintenance and Updates

Televinter’s Responsibility:
Televinter will maintain the necessary infrastructure for the provision of services, ensuring availability, performance, and security. However, Televinter is not responsible for the ongoing management of content or updating platforms not directly related to the contracted services.

Customer’s Responsibility:
The customer is responsible for keeping their websites, applications, and other digital assets up-to-date and ensuring compliance with applicable regulations.


12. Security and Vulnerability Prevention

Televinter’s Responsibility:
Televinter will take necessary measures to protect systems and servers against unauthorized access and known vulnerabilities.

Customer’s Responsibility:
The customer must ensure the protection of their systems and implement appropriate security measures on their platforms and applications.


13. Service Interruptions and Availability

Televinter’s Responsibility:
Televinter is committed to providing uninterrupted service, but interruptions may occur due to maintenance or unforeseen circumstances. In such cases, the customer will be notified as early as possible.

Customer’s Responsibility:
The customer acknowledges that, in certain cases, service interruptions may occur due to factors beyond Televinter’s control, such as natural disasters or internet connection failures.


14. Service Revisions and Modifications

Televinter’s Responsibility:
Televinter may modify the services, including changes in fees, features, or availability, based on market needs. Any modifications will be properly communicated to the customer.

Customer’s Responsibility:
The customer agrees to the changes that may apply in the next billing cycle or as indicated in the relevant notification.


15. Response Times and Support

Televinter’s Responsibility:
Televinter is committed to providing adequate response times and professional technical support. Response times may vary depending on the nature of the incident.

Customer’s Responsibility:
The customer must provide accurate and complete information to facilitate problem resolution. Failure to cooperate may delay the process.


16. Dispute Resolution

  • Any dispute related to these terms and conditions or our services will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
  • Arbitration will take place in the county where our headquarters is located, and the ruling may be filed in any court with jurisdiction.
